This Agreement constitutes a legally binding contract between Navigate UX Ltd (T/A Objective), a limited liability company organised under the laws of England (“Objective”) and the user, whether personally or on behalf of an entity (“Client”).

Definitions:

  • Website: Refers to discoverobjective.com and any other related platform.
  • Services: Refers to the services provided by Objective via the Website.
  • Content: Includes research data, software, designs, text, images, and other materials on the Website.
  • Marks: Refers to trademarks, logos, and service marks on the Website.

1. AcceptanceBy accessing the Website, the Client agrees to the terms and conditions set forth in this Agreement. Discontinuation of use terminates any relationship with Objective, except for outstanding payment obligations.

2. Intellectual Property RightsThe Website, Content, and Marks belong to Objective, protected by intellectual property laws. Personal and informational use is permitted. Commercial exploitation requires Objective’s written consent.

3. Ownership of MaterialsObjective owns Client Feedback. All Project-related materials belong to the Client. Objective transfers any unintended ownership rights of the Project to the Client. The Client guarantees materials don’t infringe third-party rights. Unless stated in Paragraph 17, Objective may showcase the Client's work.

4. User RepresentationsBy using the Website, the Client:

  • Must be at least 18 years old.
  • Won't access the Website unauthorizedly.
  • Won't engage in illegal Website activities.
  • Will respect all applicable laws.

5. Prohibited ActivitiesMisusing the Website, unauthorized data extraction, bypassing Website security, misrepresentation, interference, competing with Objective using Website data, uploading harmful software, and defaming Objective are strictly prohibited.

6. Management and OversightObjective may monitor for violations. Access can be terminated without notice.

7. Data Protection and PrivacyUsage signifies consent to Objective’s Privacy Policy, which aligns with UK data protection laws, including GDPR.

8. Returns and RefundsRefunds are determined case-by-case. If approved, a 25% fee is deducted. Legal actions may arise from violations.

9. ModificationObjective may alter the Website or Terms of Use. Significant changes will be communicated to users.

10. InterruptionsObjective doesn't promise uninterrupted access. Clients won't hold Objective liable for disruptions.

11. Subscription, Pause, and Cancellation

  • Monthly Subscription: Billed every 31 days. Clients can cancel anytime with a 30-day written notice via the client portal. After notice, the service continues for the remainder of the 30-day notice period.
  • Annual Subscription: Billed yearly and auto-renews. To cancel, provide a 30-day written notice before the renewal date via the client portal.
  • Subscription Pause: Clients have the option to pause their subscription. Monthly billing cycles are based on a 31-day period. For instance, if a client uses the service for 21 days and then decides to pause their subscription, the billing cycle will be paused, retaining 10 days of service. This remaining service can be utilized anytime within the following 12 months. Pauses can be activated through the client portal and can be held for up to 12 months.
  • Studies In Progress: If a subscription is cancelled or paused, any studies marked "In Progress" will be completed. Clients may choose to halt these studies, but they will remain fully chargeable.
  • Unused Time: No refunds for unused time. Upon cancellation or pause, we'll inform clients about any remaining unused services.

12. Governing Law and JurisdictionThis Agreement is governed by the laws of England and Wales. All disputes shall be resolved in the courts of England and Wales.

13. Limitations of Liability Objective isn't liable for damages arising from the Website's use. The Client will indemnify Objective against third-party claims relating to the Website misuse or this Agreement's breach.

14. User Data Clients are responsible for their data. Objective isn’t liable for data loss or corruption.

15. Electronic Communications Clients consent to receive electronic communications from Objective and agree to electronic signatures for transactions.

16. Showcasing Work Objective can share success stories (but not research findings) on digital channels unless an NDA prohibits it.

18. Referrals Handled through Rewardful.com.

19. Miscellaneous This Agreement, with policies on the Website, represents the entire understanding between parties.
